Pairs of speakers – one local, one foreign – will supply personal perspectives on arbitrating cases with Brazil as the seat and discuss what might be done to improve its standing globally.

Topics to be discussed:

• Anti-arbitration injunctions and other court intervention during proceedings
• Annulment of awards
• Enforcement of awards “made in Brazil”, and “made abroad”
• Local vs foreign arbitral institutions

Topics for discussion will be collected in advance from the audience, but these are expected to include: conflicts and disclosure, evidence and advocacy, and the costs associated with over-use of experts.

What dispute resolution traps should Brazilian companies avoid as they invest around the globe? A panel of international speakers will point out the legal quick-sands that might otherwise trap the unwary, taking in most of the main destinations for Brazilian investment. The session will discuss:

• issues surrounding arbitration clauses
• the best neutral seats
• treaty protection structure
• traps for the unwary
• discovery
