The NCA faced what has been unanimously described as a “major blow” in June 2011 when the country’s Supreme Court overturned a €3.8 million fine for abuse of dominance against cheese producer Tine, ruling that the facts of the case did not match the criteria for abuse of dominance contained in previous judgments.
