American Express loses bid for en banc arbitration hearing amid split in Second Circuit

The US Second Circuit Court of Appeals has denied a request for an en banc hearing in a case that pits the power of the federal antitrust laws against class action arbitration waiver clauses in contracts that are backed by the country’s Federal Arbitration Act.
