Tesco’s lawyers today presented the opening arguments of their appeal against a £10 million fine issued by the UK’s Office of Fair Trading (OFT) for conspiring to fix the price of cheese.

The UK’s Competition Appeal Tribunal has told the Competition Commission to consider “more recent developments in the relevant markets” when reviewing its findings on payment protection insurance for personal loans.

The Competition Appeals Tribunal has decided that EU law (article 81) does not cover an arrangement whereby foreign booksellers are required to observe Danish book prices in return for receiving supplies. The Tribunal took the view that no market for Danish books exists outside Denmark. Therefore all the books supplied to foreign sellers are assumed to be destined for re-importation. The judgment is the first in which the CAT has struck down a decision by one of the UK’s sector regulators and is notable for the sharp criticism of Oftel’s reasoning by Sir Christopher Bellamy, the CAT’s president and former CFI judge.
