In the wake of the European Commission’s decision to oppose Oracle’s purchase of rival Sun Microsystems, the US Department of Justice has created a list of current US investigations to help it identify antitrust agencies in other jurisdictions that may review the same deals and behaviour. The antitrust section of the American Bar Association has told both US antitrust agencies that the guidelines used to explain how they examine horizontal mergers should change to reflect current practices and economic thinking.
