The US Department of Justice’s antitrust division has told a New York federal court that it should not require financial services company Morgan Stanley to admit liability in an antitrust case before approving the company’s settlement with the government.

Morgan Stanley must disgorge US$4.8 million in profits from an agreement made with utility KeySpan, according to a settlement it reached on Friday with the US Department of Justice’s antitrust division.

A potential class of plaintiffs has filed the first private antitrust lawsuit against the KeySpan Corporation and its financial partner Morgan Stanley, after KeySpan agreed to pay US$12 million in a US Department of Justice investigation earlier this year.
